    Travel During Grandparent Visitation
    My question involves a child custody case from the State of: California

    I am going to court Monday my son grandmother is wanting grandparents visitation but wants to take my son out of state for summers and also for holidays where she currently lives and I do not agree because we had a situation where she was involved with her son taking my son out of state without any agreement when I called her and my sons dad phone they did not answer at all hrs later my son father calls me back saying he’s already in a different state with my child i was so devastated and depressed it affected me really bad I lost my job it took me almost a yr to get him back they did not want to give me no address or any location where they were at I had a hard time trying to go to court because of not knowing a address well they came back for the holiday and he decided to give him back to me and every since then I haven’t let the grandmother or father see him because I feared it would happen again I lost their trust and before all that happened my son would always visit them I never had a problem but now I do because I do not know what kind of games they are playing so I want to know will the judge take my side due to the fact that I also did a child abduction towards her and I am requesting that she only visit him in California only ?

    Are you denying either the child's father or grandmother court ordered visitation? What are the court orders if any exist?

    Were you married when he was born? Has paternity been determined if not?

    I suspect there is more than just grandparent visitation in question, but there is not enough information in your post for anyone to advise you. You realize that you may not agree with what is determined yet you must comply or risk sanctions. I hope you have an attorney.

    The father and I do not have court orders I’m in the process of filing for that but as far as the grandmother we haven’t went to court just yet it has not been finalized she requesting visitation for summerbreak and holidays and no the dad and I were never married only paternity that was done was for child support to get his DNA this is our first time going to court for anything like this

    So, you are saying that grandma has filed for visitation and you have a court date?

    Your post mixes the separate issues of grandparent visitation and visitation with the child's father. You are angry that the father took the child out-of-state? You can expect that your eventual visitation order may address your concern that you be given information about where the child will be staying and a phone number through which the child may be reached, but you can expect that dad will be allowed to travel out of state with the child.

    Whether or not grandma qualifies for visitation apart from the father is not something we can answer, given that you have not shared any facts relevant to how a court will decide that issue -- read this. If grandma qualifies for a separate visitation order, lives in another state, is willing to provide age-appropriate travel at her own expense, has proposed a reasonable visitation schedule, and there is no reason to believe that the child will be endangered by the travel and visits, you should not be surprised if the court allows the travel.

    If the father has visitation rights, normally grandma would get her access to the child through the father.

    My sons grandma is taking me to court to get visitation. She is requesting to take my son out of state where is currently located for summer break and some holidays,but I do not want that being the fact that she was involved in a situation with her son which is my sons dad, taking him out of state without any agreement.We do not have any type of court orders. This will be our first hearing . I am requesting that she not take my son out of California,she can visit him ...but only in California. It took me almost a whole year to get my son back when my sons dad and the grandma took him out of state,I did not know my sons where about or anything..

    Once I got my son back I have not been letting them visit just because the simple fact that I fear it would happen again. So,when filing response paper work the lady informed me that the it shpwed in the system that the grandmother only served me, it did not show that she served the dad but the grandmother told me she had also served her son. Now with that being said would that look bad on her. I was also told by the lady at the court that she had did her papers wrong...she was not as detailed,she only put 2 addresses of where my son lived for the past 5 years which is mt current and her previous address that is it! Also for her address she put a PO box for me to send my response back to her and her son.

    Now will all that look bad on her end because she filed her paper work incorrectly also if the grandmother served my sons dad Im suppose to get papers from him as well right which i did not receive anything and he did not respond to her paper work. Will the judge grant what I want? Will my son father get to talk to the judge without any paper work besides the ones I sent to him? Will the grandmother have to explain her mistakes of not properly serving her son and the erros on her paper work?

    Is there court ordered visitation for the other parent or the grandmother? If there is, you have to let it happen.

    What's the custody situation?

    You need to go back to court and modify the visitation. Please talk to a lawyer asap.

    So dad doesn't want visitation but grandma does? Weird. Yeah you need to find a lawyer who does free consultations.
