    Removal of Child from Home Due to Drug Paraphernalia
    My question involves a child custody case from the State of: California.

    My daugher was taking out of my care a couple of days ago. because somehow a meth pipe got into her farmers markert bag that i carried to schol and gace to the teachers ,. court is on tuesay what should i expect. she is staying with my friend and not na foster home

    You should expect a lot of very pointed and very direct questions about how the pipe got to be there, and they will not take I don't know for an answer.

    What is the hearing for? Is this CPS or criminal court? If it's CPS, it's going to get messy. The court is going to want more a few things before they give your kid back.

    yes its cps and i no that i willl have to jump hoop (in which im willing to do) to get my daughter back do u think they willl arrest me at court...or wouldnt they have already

    So.... who in the household uses? You, family member, roommate? How are you dealing with that issue?

    I agree - you need a lawyer.

    Too late to edit, so I'll just do it this way.... I'm not asking to be nosy. But I suspect it will help you in court if you/your lawyer could say "this is what I am doing to solve this issue" - be it finding new living arrangements, getting rid of a roommate, getting treatment - whatever it takes. Judges like to see someone being proactive, so being able to show that you are looking for a new place, finding out how to evict someone, researching treatment programs, etc. could shine a more favorable light...

    There's no telling when or if criminal charges will be filed. It's just a misdemeanor offense and the DA has a year to decide. With regard to the CPS case, the first hearing is a detention hearing where the court initially decides where the child should be placed. Return is possible but not guaranteed. If you are or were using, you need to stop now. If you're around someone that uses, they need to go and stay out of your life. The court will likely want drug testing, parenting classes and home checks before returning the child to you. If they do return at the court hearing, you must jump all their hoops to keep it that way. If you can't afford counsel, the court will appoint counsel to represent you if you ask for it which you should.
