What is the Statute of Limitations on Out-Of-State Credit Card Debt
My question involves collection proceedings in the State of: Georgia
I have a large credit card debt which was incurred when I lived in California. I now live in Georgia. The debt has been delinquent five years, and is in for collection.
Can I claim the more favorable statute of California (4 years), since the debt was incurred there?
(the statute for cc debt in Georgia is six years)
Re: Statute of Limitations on Out-Of-State Credit Card Debt
The statute of limitations applies to the state that they sue you in. They can sue you either where the debt took place (presumably this is California) or in the state in which you now reside. YOU don't get to choose. Georgia also doesn't appear to have a borrowing statute that allows you to enforce California's shorter duration.
