Relocating With a Child to Another State When Non-Custodial Parent Lives Out-of-State
My question involves a child custody case from the State of Indiana.
I know I have to notify non-custodial parent if I want to move out of state, but wondering if there should be any issues as she already lives in another state and we are currently going by the distance guidelines. I don't expect she would complain as he would just have to fly to see her (which he already does). But if she did, should there be any foreseeable problems given she already lives out of state? She is in Virginia and we are thinking of moving to New Mexico. I have sole custody and child is 15.

As long as she does not have to absorb any additional costs associated with you increasing the distance between homes, and as long as your move would not impact her current visitation schedule, you should be ok. You need to give her 90 days notice of the move and if she does not file anything in court within 60 days of the move you should be good to go.

Thanks, thats what I was thinking. Visitation would be the same and he spends summers with her.
