How to Expunge an Arrest Record After a Charge is Dismissed
My question involves criminal law for the state of: Ohio
I was falsely accused of crimes by a mentally unstable woman who I have since separated from. She accused me of these because I told her I was leaving her.
My charges have all been dismissed now and she has a warrant out for filing a false police report.
How do I go about getting the arrest and charges themselves expunged so that they no longer show up on court database searches, or when police run my DL?
Re: How to Expunge an Arrest Record After a Charge is Dismissed
You cannot make the records completely disappear, but sealing will render them non-public for most purposes. The threshold for sealing the court record is a bit higher than that for sealing the criminal record, but both requests are made through a petition to seal the record. See O.R.C. Sec. 2953.52, (B)(3)-(4). You may be able to get general or court-specific forms and instructions for sealing your record from the court in which the charge was filed (for example).
