Do You Have to Include Your Minor Child in Divorce Papers
My question involves a marriage and child custody case from the State of: Calfornia
My husband and I have been in a relationship for years thats been somewhat platonic. We are polyamourous and We are friends and live together. During the course of our marriage I had become involved with someone else. And my husband and I chose to stay married.
My partner and I have a child and he is on the birth certificate as the biological father. We all live together as a giant family and my child considers both males as dad.
Recently, my husband and I have decided to legally divorce.
I am wondering if I have to put my child on the divorce papers?
Re: Do You Have to Include Your Minor Child in Divorce Papers
Yes, you must file the case as a divorce involving custody of a minor child, and you must include your child in the divorce pleadings.

Even if my husband is not legally the childs father and not on the birth certificate?
Re: Do You Have to Include Your Minor Child in Divorce Papers
That's why the minor child needs to be mentioned in the divorce - to declare that your husband is legally not the child's father and that the child is not a product of the marriage.
