    Parent Charged With Kidnapping Children After Violating a CPS Order
    A mother in Kentucky was evicted from her home so she got a hotel for the night with her kids. The evictor decided to call cps because technically she is homeless and is still spitefull from the ordeal.

    The next day cps shows up and tells her to find a home or the children will be taken. Next day in the process of finding a new home cps told her that she need to move back with her parents/ find a place to live but shes not allowed to stay in a hotel until she finds a place. (She has a job as well)

    2 days later cps tells her to come to their office to discuss her plan. She shows up and in front of the office with a plan of a place to stay but the cps person pulls out a piece of paper and says their taking the kids. She has a freak out moment and just plainly tells her that she cant just take her kids. She get back in and drives away. No running or danger but just drives away to her childs school. She gets pulled over and completely complies and there is no resistance.

    This is her first offence ever. She is charged with two counts of kidnapping a minor which are her children. At the childrens court the judge is thinking joint custody between the mother and father. She is still in jail though and still has pulmonary court to go to.

    My question is what do you think will happen? Is she really going to end up in prison for 10 to 20 for this? The judge said joint custody but she is in jail with those charges. We are hoping its a scare tactic. Any thoughts as to what will happen helps. Our family is hurting and we have no idea what will happen. Sorry for the bad grammar and spelling. Were having a hard time.

    First there is clearly more to the story. CPS didn't take her kids simply because they were in a hotel unless it was a REALLY bad hotel.

    Ok so a little more detail: This was literally only a 6 day ordeal. The CPS worker told her that she couldnt stay in the hotel.
    She has the money and the job for a rental but the CPS worker said that because of the eviction she would never find a place to rent in this town.
    That was told to her day 1.
    Day 3 she was again told to find a place or go hone or risk the kids being taken.
    Day 4 she looked around and found a few places and was waiting to hear back from them.
    Day 5 CPS said she can move in with a renter as long as they get their info and she gets put on the lease.
    Day 6 she decides to move in with the renter in the mean time and goes to meet CPS at her office where the incident occurred.

    This is the info i have. I just need any sort of advice.

    The best advice would be to get a good lawyer. Actually two will be needed one for the criminal charge and one for the family law issues.

    Like I said before simply staying in a hotel isn't grounds for the state to take you children. If that were the case nobody could ever go on vacation.

    She will have a public defender from what the jail is telling me. The father of the children just got a job and is renting an apartment and we just got the news that the judge is going to give him the kids as joint custody as long as he meets certain criteria.*

    So it looks like the kids will be coming back to family. Now we are worried that she will do time. I just feel with a completely clean history that maybe probation would be enough.

    Also your thought of that not being grounds to take the children, thats legitametally what happened. I wish there was more because we are all in shock that over the span of 6 days they were taken from her.

    I am just wondering what they will give her at this point

    even that sounds unrealistic. There is nothing inherently wrong with staying in a hotel, especially given the timeframe you speak of.

    Re day 5: nope. Requiring her to sign a lease? Not happening

    there is a lot more missing. Cps doesn’t involve themselves this deeply this quickly without some serious issues going on.

    Evicted for not paying her rent which is understandable. Actually other tenants in the building did the same thing as well, it was in single digits temp and the realtors never fixed the heat or the other work orders that were there for months. Most were forced to go elsewhere or buy their own heaters.

    It sounds unrealistic and i wouldnt believe it either if i hadnt been their for the first encounter with the cps.
    Yes i heard the cps worker actually tell her she had to be on a lease to prove she had a stable home

    I just want her to be able to get out so we can all get this back on track

    What do you think they will give her?

    Sorry for all of these posts. I just want to see what other people think she will get as punishment now that were sure we can get the kids out of the system.

    I wake up everyday thinking its a dream.

    I agree there is much more to this story.

    For the record, a tenant cannot withhold rent. Was she legally evicted ? Or did the landlord tell her to get out ? There is a big difference. If the landlord did not do as the law requires for a legal eviction. Legally, she was not evicted. She left if her own choosing. She also was aware of no heat and other problems. She could have found another place to move to instead of not paying her rent

    There is something wrong with this story. I used to work for a hotel and we used to get calls from Social Services asking if we had rooms available for them to place people in.
