Accused of Indecent Exposure After Peeing in the Woods While Camping

My question involves criminal law for the state of: California.

My friend went camping seven months ago with her now ex-boyfriend and his kids and her kids. She had to use the restroom outside and did so behind a tree. She has a restraining order against this guy because he is crazy. He has tried to accuse her of the same situation of indecent exposure and the judge threw it out already. Now seven months later he made a report to it officer saying she Peed in front of the kids and now she’s being called and being questioned about the incident. She did nothing wrong they were camping.

This guy has violated the restraining order several times and police did nothing about it he has been harassing her constantly she is a single mom of two girls that she loves very much. She is so scared that she’s going to lose her girls over this false accusation. The police officer that Called her was very rude to her asking her questions.She felt the need to defend herself and told him that they were camping and when she had to use the bathroom she went behind a tree. She said a couple of the kids were laughing shining flashlights and she told them to stop.

She never had any intentions on exposing herself. Can an incident that happened seven months ago be brought up now. And is it against the law to go Pee behind A tree while camping? There was no buddy else except her kids his kids and the two of them. She did not just pull her pants down and Pee in front of everybody she went behind a tree. Any help would be appreciated just want to calm her down she is so scared she’s going to be in trouble and lose her kids over this guys false report.

Unless it was an organized campground with bathrooms available its totally normal to pee behind a tree. Your friend did nothing wrong. This guy is just trying to make her life miserable by pulling these stunts.

I would suggest that she change her phone number so that she cannot be easily accessed. Its also possible that the person she was talking to was NOT a police officer.

There was bathrooms but they weee far away and it was dark. This was 7 months ago and now he brings it up!! What should she say to the police officer if he calls back.

In the exceedingly unlikely chance that the police officer calls back AND she has confirmed that he is really a police officer and not someone her ex is getting to call her, she should say nothing until she talks to a lawyer. However, the chances that this is really a police officer calling are slim to none, and slim just hopped on an out of town bus.

I really, really, really can't see any prosecutor agreeing to charge her with anything. Her ex is playing her. Tell her to stop listening to him.

She changed her number so now nobody can call her. But what if it was a real police officer and now she’s not able to be contacted? Her ex is a nut job!! Thanks for all your help. :)

It wasn't a real police officer. Trust me.

Without a complaining party to be offended, this will not be a crime. The act must also be lewd, and this element is rarely met when someone is trying to urinate in seclusion. Although,there IS a section about urinating in public, but I cannot imagine it would be applied to a campground.

Your friend should be just fine with regards to her public urination.
