My Husband Wants To Adopt My Daughter

We live in the state of Nevada, and E's bio father lives out of state. We have a custody order in place giving me sole physical and joint legal, however it is written on a temporary basis, it was put in place in June of 04. This order is in the state of MN. We have been in LV now for 3 years. He is also required to pay child support and does not. He is allowed only supervised visitation due to his drug abuse. He calls maybe once a month, and visits once a year for 2 days. My daughter knows my husband as her only daddy, he has been the only man in her life since she was about 5 months old. He would like to adopt her, however I don't think the bio father will give up his parental rights. If he will not, is there anything else that can be done? Is there any motivation tool I could use other than child support? What happens to him if he just doesn't pay the support he is required, are there any repercussions? Is this situation considered neglect? Thank you for your help!

Given his sporadic contact, I don't think you could successfully terminate his rights at this time. Ask for his consent. He may be happy to end his child support obligation.

You probably want to call an attorney who does stepparent adoptions--they are fairly routine and the attorneys dealing with those kinds of cases know the standard forms, etc., that the other parent could fill out regarding consent.
