Can My Boyfriend Kick Me Out of His House if I am Not Ready to Leave
My question involves landlord-tenant law in the State of: MO
I have lived with my boyfriend for almost a year. He owns the home and all utilities are in his name, except for the cable, which is in my name.
There is no lease, just a boyfriend/girlfriend relationship.
I want to move out, but because I want to move, he his trying to force me out without having anywhere else to go.
I do give him money to help with the bills, groceries, etc. It's cash and nothing is documented.
Can he do this? Can I refuse to leave? Should I call the police?
I am not prepared to move out immediately. I need some time. He is saying that he doesn't have to give me any notice.
Re: Can My Boyfriend Kick Me Out of His House
He can terminate your tenancy and if needed, have you evicted by the courts just like any other tenant in Missouri.
Offhand i don’t know the time periods required for a proper notice but generally it’s a month in most states.
until a court orders the eviction, he cannot stoop to a self help eviction.
Re: Can My Boyfriend Kick Me Out of His House
He needs to treat you like a tenant and give you a 30 day notice if he wishes to evict you. Google "missouri tenant rights eviction" and you'll find what your rights are.
But the practical adviceis this: if he has a history of violence, or you fear for your safety, get ALL your things together quickly and get out.
Re: Can My Boyfriend Kick Me Out of His House
Thank you. I am not afraid for my safety. I want to know my legal rights.
So , he can't just lock me out, or sit my stuff out (I mean he can), but would the law be on my side if I had to get police involved?
I will get out as quickly as I can, but I just don't have the money or a place to go anywhere immediately.
Re: Can My Boyfriend Kick Me Out of His House
Playing devil's advocate...
He changes the locks, takes your stuff to the dump...
You call the police and state you live there.
He denies that, saying you only slept over there a couple of nights a month for whoopee - or whatever.
So now you have to file a case, take him to court and maybe get some $$$ - but you would be lucky to get that heard in two months. And from your message, it sounds like you plan on moving sooner than that.
Not to mention he has paid all the bills except the cable bill which he will state is your Christmas present to him. Your name isn't on anything. Sorry, sweet deal for him - he's set himself up well. Probably a good learning experience. Get your stuff, and move out fast - or renegotiate the terms and get it in writing.
Re: Can My Boyfriend Kick Me Out of His House
The police are very unlikely to help you because this is a civil not criminal issue.
If he illegally evicts you your only option will be to sue him for damages.

If she were anything like me she would have all kinds of mail in her purse with that address on it. She would have a driver's license with that address on it, and maybe even some other ID with that address on it.
There are some police that will tell the person that they cannot lock out the other person.
Re: Can My Boyfriend Kick Me Out of His House
I receive my mail here and have for 9 months.
Re: Can My Boyfriend Kick Me Out of His House
So please take the advice given here and start storing the evidence away. I strongly suggest you move sooner than later because most likely, your recourse will be to sue for damages after the fact and not force him to let you stay there. Methinks he can kick you out in the next ten minutes and you will be on the streets.
You may wish to look into storage units and some hotels offer low monthly rates as you search for a permanent place. I have to wonder why you're still there. You want to move, he knows it and threatens to kick you out. Why haven't you moved? Why hasn't he followed up on his threat?
