What Happens if You Transfer Probation but Have Open Warrants from a Third State
My question is if I was suppose to do jail time and probation and left the state of Oregon They put out misd warrants 2 years ago. I recently got a felony charge in Montana and plead to 3 years defferd they new I had warrants. I now live in Washington and will transfer it to Washington if they approve it. Will Washington take me to Oregon???
Two Different State Probation
So I got an assault 4 a few years ago I left the state. They put out a few misd warrants. Last year I got in a bar fight and got criminal endangerment in Montana. I was given 3 years probation with a three year defferd sentence. Now I lived in Montana at the time.but i have lived in Washington for the last 6 Months.i am getting my probation transfered will being in Washington be a problem due to the Oregon stuff?? I now have been married have kids and am sober.
Re: Two Different State Probation
Having an outstanding warrant is always a problem. Given you are wanted for absconding and youre moving right next door (state wise) don’t be surprised if they are willing to extradite.
The only thing being married, having children, and being sober means is your wife and kids will miss you and you won’t go through alcohol withdrawal.
Re: Two Different State Probation
Even tho I called Oregon and asked they said unless you go to Oregon you will be fine. I did not tell them all be on probation next door.
I did not think they would care since there not felony warrants. But good to know. The only reason I am curious is I do t want it to effect my deferred sentence. Maybe I should hire an attorney.
Re: Two Different State Probation
Many states won’t extradite for a misdemeanor but that doesn’t mean they can’t. It also doesn’t mean you won’t be arrested and held in a washsington jail until Oregon says yes or no should you have contact with a Washington cop and they see the warrant.
Re: Two Different State Probation
So would Washington except my probation means that I have warrants in Oregon..I am confused.
Re: Two Different State Probation
That’s entirely up to Washington. Washington may not even see the warrants. Maybe they will and ignore them. There is no way to guess
I wouldn’t suggest lying on any of the paperwork you have to fill out though. That is likely a crime in itself.
Re: Two Different State Probation
Ok thanks for your help I appreciate it.
Re: Warrants and Probation in Two States
It's not a question of whether Washington will take you to Oregon, it's whether or not Oregon will come and get you. Nobody can predict that.
