Found in Possession of a Controlled Substance That I Thought Was Over-the-Counter
My question involves criminal law for the state of: Michigan.
I was searched the other day and was found with adderal. I had no idea that it was on me. I was told it was Aleve- I take ibprophen so at first glance I was like “oh okay.” I had two on me and I’m not sure what’s going to happen next. I know it was stupid of me to take something from someone and 100% believe them as to what it is. However, will I be charged the full 25,000 and 4 years of jail anyways? Even if I didn’t know what I was possessing?

If you don't have a history for criminal possession of drugs, talk to your lawyer about MCL 333.7411 ("seventy-four eleven"), a deferred sentencing statute for first offense simple possession.
You can also discuss with your lawyer exactly how you came into possession of the drugs, and why the person who gave you the drugs might have lied about the nature of the drugs.

Be prepared to be disbelieved. It is not common for people to give away their Adderall and even more uncommon for them to lie about what it is. Most people will think that nobody does that.

While I agree that it would not be common for someone to voluntarily give away their Adderall, I have no idea what the size, shape and color of the pills are, compared to Aleve. If the person who gave it to them just kept a few different kinds of meds in the same bottle in their purse (lots of people are guilty of that with no idea that it could get them into trouble) then there is a chance that it was an actual mistake.
I just did some googling and both Adderall and Aleve come in little round, blue pills. They also come in different forms as well. So, there is at least a chance that it was a mistake.

Too late for our OP, but for anybody else looking at a pill and wondering whether or not it is Aleve, the best way to determine that is to read the imprint on the pill. If it says "Aleve" on one side of the tablet, unless somebody is going through an extraordinary amount of work to trick you, it's Aleve. If it does not say "Aleve" on the tablet, then it's something else.

For the sake of argument Naproxen (generic Aleve) does not have Aleve imprinted on the tablet. Only Brand Name Aleve does.
I do not believe the OP had no idea he or she had Adderall.

Of course your “friend” will call the police and tell them they accidentally gave you a couple adderal from their legally prescribed and purchased prescription which they can prove, right?
If not, plan on taking the fall for this.

An acetaminophen tablet is not "Tylenol" unless it's manufactured by Johnson & Johnson -- that's a brand name medication. The same is true for naproxen sodium vs. "Aleve". If the pill does not say "Aleve", it's not Aleve.
But let's go with generics. You should go to a site like drugs.com and use the pill identifier to find out what it is you've been handed.

But who actually thinks of doing that? Only someone who expects trouble. There are a lot of naïve people out there.
