    Do You Have to Provide Half of the Transportation if the Other Parent Moves
    My question involves a child custody case from the State of: California

    Dad is planning on moving to Arizona to earn more money. Since he is the one moving, will I need to drive half way to meet him? We currently have 80/20 custody with the kids being with me 80 percent of the time. He has told the kids that he and I will split the cost but has not said anything to me about him moving. How does this work?

    With some exceptions, which generally have to do with logistics, the parent who creates the distance is responsible for increased transportation for visitation. Its APPALLING that he is discussing the cost of visitation with the children!

    Where in CA and where in AZ?

    We are in Bakersfield, CA and he wants to move to Needles, AZ. It is disheartening that he shares it with the kids.

    I had hoped that I could figure out the distance with that information but MapQuest does not seem to recognize Needles, AZ. So, can you give us the actual distance?

    I am trying to figure out whether or not regular weekends are actually feasible, legally, with the distance.

    He has mentioned Bullhead City, AZ and Kingman, AZ.

    Sorry, he plans to work in Needles, CA and live nearby in Arizona for tax purposes.

    What do the court custody papers say about visitation and expenses? It may be that you and he will have to go back to court if the orders specify a specific location or process in the orders and these can no longer be adhered to.

    We went through a paralegal and didn't address this in the divorce.

    If the divorce decree is silent on custody and visitation, where do you get that there is an 80/20 split, and how is it enforced? If the order is silent, you might want to go to court to get something in writing that can be enforced. No order is a BAAAD idea for both of you. You can withhold visitation without much chance of any consequence, and he would not necessarily be under any legal obligation to return the children to you after his 20% time.

    Go to court and file to obtain a proper custody and visitation order if it does not yet exist.

    Well, Bakersfield to Needles is 272 miles (a little over 4 hours). Further if she wants to go to where he might end up living in AZ.

    Add 30 minutes or an hour for the listed AZ locations.

    Ok, that is far enough that weekends are not really feasible unless dad drives to Bakersfield to see the children or unless mom meets half way. That might possibly make a judge decide that mom should have to meet dad half way so that the children see dad more often than just holidays and summer. I am not saying that its a slam dunk that mom will have to drive half way, just that its feasible that she could be ordered to do so.
