Can You Run Away From Home to Live with a Friend
My question involves juvenile law in the State of: Utah
I am living in the state of Nevada with my Mom and her boyfriend. I don't get along with my mom too well and I usually end up getting into fights with her and trying to avoid her. My dad passed away 4 years ago so living with him is not an option. My dad lived in Utah where I was born and raised for a few years. I am wanting to move back to Utah and was wondering if I can just move into a friends house who is willingly open to accept me into their house. Can I move with parents consent or do I need to get a documented Guardianship transfer in the state of Utah?

When you are 18 you can decide where you want to live. Until then you need your mother's permission.

I Know that, But can I just have Consent from a parent to live with someone else or does it have to be documented guardianship?

If your mom says it is okay to live with a friend in another state,and she can make the arrangements for you to attend school and care for you (including medical insurance - tough to do in another state), then you can live with your friends provided no laws are being broken. In other words, if she allows you to move in with a "friend" in order to engage in sex or other illegal activity EVERYONE could get into trouble. Most the time when we see these requests it is because someone wants to move in with a romantic interest.

So she would need to sign documents for me then still to go to school? And no I am moving for a better college opportunity with football and the betterment of my self emotionally and physically. I have a lot of other family and friends out there and a friends parents who treat me like their own. So in the state of Utah I can just move into someones house without the transfer of legal documentation of guardianship but instead just consent or parent permission??

The school will almost certainly want something from a parent or legal guardian. I had children living with me in just this way, and we had to get written permission from parents to make these decisions. Your state,your friend's state,and the school may have different rules.

The basic rule is you can live anywhere your parents allow you to live. But, THEY will have to make any legal arrangements that might be required. It might be wise for your mother to contact a social services agency in the county where you will live to find out what your friend's parents might need to get you into school and to allow you access to mom's insurance. Mom should also check to see if her insurance will even cover you out of state. If not, she may have to make other arrangements if she wants to do this.

So in the state of Utah do you know what the legal actions would be to allow me to live with my friend and his parents?
Or what would be the easiest way for me to transfer a state over to Utah?

I am not familiar with the laws, policies, or common practices in this regard for the state of Utah. That is why your mother should make some phone calls in the morning if this is something she is interested in allowing you to do. If mom is NOT going to permit it, then it's not going to happen. This is her call to make.

There is also the issue of health insurance. Your insurance in Nevada may or may not cover you in Utah, and your friend will almost certainly need not just an informal guardianship, but one ordered by the court, for your friend's family to include you on theirs. That's another thing your mother will have to investigate and that you very likely cannot. She's going to have to be involved, and she's going to have to be willing for it to happen. It's not going to work otherwise.

Is your mother receiving SSA Survivors Benefits off of your father's work record for you ? If she is, she will have to decide who she wants to be your Representative Payee.

How hard would it be for the court to order a transfer of guardianship? Of course the family I will be living with has a lot of money and a really nice living condition. They are very good guardians. And no I do not think we are receiving Survivor Benefits

If your mother is in favor of it and grants her permission, and if your friend's family is willing to have you living there, it shouldn't be a problem at all. Courts see this sort of thing all the time, when for reasons of school or otherwise a parent grants permission for a child to live with friends or relatives for a year or two. It's all in a days work for the court, as long as everyone agrees.
If your mother is not in favor of it and doesn't grant her permission, it is highly unlikely that a court will order it at all.
