Can One Co-Tenant be Asked to Pay Rent Owed by Multiple Roommates
My question involves collection proceedings in the State of: Texas
I was living in an apartment with 2 other people. All 3 of us were on the lease and 1 decided to pack up and move out with no notice.
Myself and my other roommate ended up being evicted. The eviction went into collection immediately.
This all took place about 3 years ago but until now has not been a problem.
The debt and eviction is on my credit report and preventing me from moving into my own place.
At the beginning of this entire collections process i did receive letters for collection that were mailed with all 3 of our names.
Despite this i'm being asked to pay the entire amount of the eviction charges.
Now my question.
Considering that the debt is due by the 3 of us is there something i can do to pay only my part of the debt and be done with it?
I'm looking to dispute the collection and speak with the agency handling it about all of this and need more information for myself so i know my options.
Thank you for your time.
Re: 3 Tenant Eviction in Collections
The three of you are jointly and severely liable for the debt. That means each of you owe the debt, the entire debt, at least regarding it being owed to the landlord. There is nothing to dispute.
With that being said, the statute of limitations on contracts is 4 years. If they don’t sue you before that time they can no longer obtain a judgment for the debt.
How the debt is worked out between the three of you is whatever was agree bybthe three of you. If you believe either if the other tenants owe you anything you can sue them.
