Gun Rights After a Felony DUI
My question involves criminal law for the state of: Montana
I received a felony DUI in 2004. I am now a free man totally off paper and have been since 2007. I finally decided to see if I could buy a gun today after all these years and my application was denied. Is there anyway or process I could possibly go though to get my gun rights back?

From conversations with my friend in a similar situation in Park County, I don't think Montana expunges felonies unless the conviction has been over turned in court, which yours and his hasn't. The application to purchase a firearm is Federal, so you'll likely have always have a problem passing that litmus test. I'm sure you're aware of this finding, which solidified the Feds hold on Montana (and other states ) gun laws. Previously, if a person had completed his sentence, Montana granted gun rights to felons. But the 9th Court has found that Fed laws apply also.
