    My question involves labor and employment law for the state of: florida

    i am an employer in florida, i run a yogurt shop, all my employees are part time. One of my new employees (about3 weeks old) has been suspended because there are 2 deposits missing both from days he was closing. I have never had this issue in over 7 years, all of a sudden the 2 days he is closed those deposits are gone. I am the only one who knows the safe code so no one else could of opened it, he says it was not him and i have checked cameras but there is non in my office where safe is so i can not see. All arrows point to him but i can not prove it, i have told him i cant put him on schedule til i find out what happened, i have talked to every employee and they all have zero clue, the deposits add up to around $650.00 total. I have never had this issue so i am not sure if i can fire him without proof, or if suspicion is good enough. Any advice would be great.

    If you are stating that the money was in the safe, and that your employee had no access to the safe, it would be interesting to hear your theory as to how the employee supposedly accessed the safe. If the employee did have access to the safe, and can be seen on camera as the only employee who went into the office during the times at issue, that would suggest that the employee stole the money.

    You can report the theft to the police and let them investigate. If your employee denies taking the money, then absent some evidence that the money was left in the safe and that he was the only person who could have subsequently removed the money, it is unlikely that they'll pursue criminal charges.

    As you believe the employee stole $650, it's reasonable to say that this should by now be an ex-employee.
