Can Guardians Take a Baby Away from a Teenage Parent
My question involves a person located in the state of: Georgia
My friend and her mom have custody of their niece/grand daughter. The minor is 16. She thinks that she may be pregnant by her boyfriend(which is not me). She has been told before that if she gets pregnant that they would take the baby from her. She has confided in on this issue. I am trying to find out what can be done to protect her rights to keep custody of her baby if she is. Also she receives death benefits from the death of her mom and dad. Will she loose these benefits if she is pregnant. Thirdly, will the state of georgia allow me to get guardianship to allow her to be able to stay with me and my wife to finish high school and keep custody of the baby. Lastly, can her aunt and grandma legally take custody of the baby from her with her being a minor. She was told that of she got pregnant that they would take the baby and when they dealt she was fit they would give it back. I do not trust them on that. Thanks

They cannot force her to give them guardianship or custody of the baby. They might pressure her into doing it, but they cannot force her. Pregnancy would not cause her to lose her SS survivor's benefits.

You would NOT be able to get guardianship or custody of her. You would not have standing.

Did the court order for mom to lose custody ? Is CPS involved ? If the court and/or CPS are involved there is much more to this. If CPS found mom did not properly care for the first child and the court agreed. CPS may take another child as soon as the child is born. It depends in the circumstances.

Third parties are rarely, if ever, told the entire truth about situations like this from those involved.

OP why are you asking about death benefits? Does your friend think someone is going to die over this? Who/why/how?
