Can You Be Charged With Statutory Rape for Getting a 17-Year-Old Pregnant

My brother lives in Florida. His girlfriend is 17 and he's 19. When they started dating she was 16 and him 18. His girlfriend is pregnant so can he get in trouble cause of that?

It looks like your brother is safe. However you can expect her parents to be quite unhappy about the whole thing. If they bar him from seeing her he must stay away or risk getting in legal trouble that way.

"Florida statutory rape law is violated when a person has consensual sexual intercourse with an individual under Age 18. Close in age exemptions exist, allowing minors aged 16 or 17 to engage in sexual intercourse with a partner no older than age 23." Legally he's good. But I bet her parents won't be very happy.

They can until he is legally determined to be the father. And even then, if the child's mother is still under 18, it only grants him access to the baby, not to the 17 year old.

Well, the original question was whether the young man can get in trouble if she's pregnant. That's predicated on the proposition that he is the father, isn't it? And if the 17 year old wants to marry him she can petition a judge who will grant that permission over the parents' objections.

And, as a practical matter, it would take foolish parents indeed to prevent a child's mother and the child's father from seeing each other for a partial year only to have their restrictions evaporate for the following 17 years. Two responsible people with a child together will always have contact until the child is grown at the very least.

They can certainly bar him from seeing her while she is pregnant...which would have nothing to do with him seeing the child. Also, the question of them being two "responsible people" is certainly an issue.

I see nothing foolish about two parents deciding that their pregnant 17 year old daughter does not get to hang out with the guy that got her pregnant. I am not arrogant enough to think that the small amount of information provided here gives me any right to even have an opinion as to whether or not they would be considered to be "foolish".

Their ability to bar him from seeing her is not certain. If she decides to marry him, there's nothing the parents will be able to do to stop that. Rather than have her rush into such a situation, a wise parent would do better to try to keep their relationship with her in a state that will allow them to have some influence. You may think me arrogant, but I've raised four daughters to adulthood so I do have some experience with 17 year old girls.

For marriage before age 18, can deny consent. If she attempts to get a court to grant permission to marry despite their opposition, they can oppose her petition.

There is currently no state in the US where a minor can marry without parental consent, consent of the courts, or both. Few courts are going to grant permission for a minor to marry in opposition to her parents' wishes.
