    Can you keep your primary residence in either a chapter 7 or 13 if you have the income to make the payments?

    Yes. You can reaffirm the loan. If you owe more than the property is worth, you may be able to get a partial discharge of the mortgage. Discuss this with your bankruptcy lawyer.

    The house is deeded to myself and ex husband with myself and two children living in it.

    My name is on the mortgage only.

    My half of the equity is probably around 12k...it is in PA.

    I have a job and can afford the payments.

    You should be able to keep it. 12k in equity can be exempted.
