    Can You Claim Abandonment After a Temporary Change of Custody
    My question involves child abuse or neglect in the State of: Texas

    So my sister is freaking out. She is in need of a little help from her kids dads. 2 great dads. One however would like to be the custodial parent. Although he's promised no sketchy moves we just want to be safe.

    There is a child support order in place. She is custodial he is non custodial...

    However in the last weeks shes had a super rough patch! Her kitchen caught fire. It is torn apart and there's smoke damage to the whole house. (No one was home or hurt) they acquired all the materials and her husband began repair. Its been a slow progress as it bc he's kinda learning as he goes... (Ohh boy:)..) anyhow he is there provider as well. Well this Monday he was in a very bad motorcycle accident and was in the hosptial in critical condition. He's improved but still in the hospital and a long way from recovery or work. He's all broken.

    Anyway its gonna be a long while before the house can be restored so shes asking her girls dad if they can stay with them thru January(ish) beginning of the new year.

    Is there anyway her daughter's dad can file abadoment in a less than 3 month period?

    And/Or

    Can he file to be custodial parent once child is in his physical custody?

    Abandonment is a non-issue but Dad can absolutely file for custody once the child is in his care full time.

    Even if they have an agreement verbally and via text msgs?
