Creating an Affiliate Program for an Employer
I work for a company as a marketing and IT guy. I also manage websites and build them. I have a few "hats" here. My company pays me well but I just had a kid and found out well is only so so after a kid haha
I love my job and would do nothing to make my employer not trust me. I have a plan that might could make me and my employer thousands more each year but I am afraid to ask in fear he might shoot it down or it might be considered some form of conflict of interest.

Let me go into a few details:

We sell stuff online and currently we do most of our advertising through adwords. I want to start up an affiliate program to help push our sales further. I want others to help us sell our products for a generous(compared to the amazon affiliate program) commission for every sale. Along with others selling our products for a commission, I want in on this as well.

I would like to create a site of my own to promote our products in the google organics where our eCommerce website does not rank very well. I have worked a bit on its ranking and made it move up a few spots in the popular keywords. However, I think its one thing for a business to tout its product as great and another thing for an individual review and view of a product.

I want to create the website from an individual perspective and try and promote from a level we can't on the cooperate website. I want to do this "on the side" to help me bring in a bit more income. My problem lies in that he might tell me to do this for him as part of my current pay. I feel it could make us both more money if we pursue this.

Is it risky to ask him to let me in on the affiliate program? I am basically asking in a sense for a commission on top of my salary here for sales I help generate. We take up one more spot in the organic google results and might help lead more customers to our products.

You can propose whatever you would like to your employer. If they like the idea, they may implement it. Whether they would allow you to participate as an affiliate or otherwise earn additional income from the program will be up to them.

One problem I could see with that is that being both a W2 employee and a 1099 contractor for the same employer is problematic from a DOL Wage & Hour Division standpoint.

Another might be that in your JOB you would have access to the raw data and could (not saying you would) be able to mess with the numbers.

It's an automatic no if you never ask. Your approach to this is key. How close are you to your "boss" now? He is not as concerned about your well-being as you are about your own. Can you do a "trial" sample with him and assess the situation in phases. You can negotiate phased in compensation as the "product" produces. If all else fails, you can reach out to other competitors.
