    What Happens to Joint Custody if a Primary Custodial Parent Moves Out of the Country
    My question involves a child custody case from the State of: Tennessee.

    I have primary custody of my two teenaged children. My current spouse and I are entertaining the idea of moving out of country. The children's other biological parent has visitation rights but chooses not to see or speak to the children. He is court ordered to pay child support directly to me but had never made a payment. I am not interested in pursuing cs.

    What would be the steps I need to take in order to legally move the children out of country?

    You need to file in court for permission to relocate the children outside of the country. These children are teens. Have you considered what they might want? Teenagers might not be too interested in moving away from all of their friends to live in another country. If you wait until they are adults, you won't have to worry about permission.

    I'm not a lawyer. If your ex hasn't paid CS and has never seen his children for awhile, then it shouldn't bee too difficult to get court's permission to relocate. I also agree with ASKING your teens what they want. I can't wait til my son can have a say where he "wants" to be, with his mom or myself. Good luck.

    That's not necessarily true. She still has to petition the court and the ex has to get a chance to show up and speak his side. If he doesn't show up that makes it easier. But no one can say it shouldn't be too difficult. It could become difficult if the ex fights it.
