My Mother is Trying to Take My Child
My question involves a child custody case from the State of: West Virginia
A few years ago I signed over temporary custody of my child to my mother because of personal issues. The original aggrement was that she would sign custody back to me when I got back on my feet. When the time came she, my mother, refused to sign custody back to me. Therefore I fought in court to get custody. After years of court dates and endless fighting with my mother I was awarded custody, but they gave my mother visitation. She was supposed to see her every weekend or whenever we both agreed was convenient.
Halloween of 2016 I went to my mothers house to pick up my daughter after I got off work. When I tried to pick her up my mother refused and started a fight which then upset my daughter and she was crying, my mother continued to yell and cause a scene. I then grabbed my child and put her in the car and left. After that incident I tried to call my mother and she refused to answer my calls. My sister also tried to contact her but she wouldn't speak to anyone. This went on for a few months. I called numerous time and even tried to go to her house and she refused to answer. Around Christmas time I started having police and CPS come to my house because of calls and false allegations my mother had made against me, which she had done a lot in the past. The harassment continued over the next few months and it got to the point where I was living in fear of someone taking my child. I decided in April 2017 to move to Florida.
About a week ago I had a CPS worker come to my house because of an anonymous call made to their office, which I know was my mother. So now its been a year since my mother has seen my daughter. Next thing I know I get an email from my lawyer in West Virginia that says I have a family court hearing in a week. I don't know what to do. I don't want to loose my child and I also don't want to continue to be harassed by my mother. I cant call or contact her because she has moved and changed her number. What should I do?

What did CPS want to talk about when they showed up? You may not need to do anything though I would go back to court and get the visitation revoked which you should have done when she refused to return your child.

You do not have to worry about losing your child. A judge cannot take custody away from you for disobeying a grandparent visitation order. The judge can seriously fine you, and even put you in jail for contempt, but the judge cannot take custody away from you.
You really need an attorney to take care of the matter for you in West Virginia, however, if you cannot get an attorney to represent you and/or cannot get to court in WV yourself and miss the hearing, then you will need to make sure that you never set foot in WV until you are able to get an attorney to represent you.

They said they got an anonymous call regarding my child. They told me that I was accused of using drugs and neglecting my child.
Im waiting on a lawyer in WV to call me back. I know that I wont be able to go back to WV for the hearing. Im working to just make ends meet. Do you think that they will try to have me put in jail here in florida if I dont go to the hearing?

Its not very likely. If you were to get stopped for a traffic ticket or otherwise have contact with the police you might end up in jail in FL until WV decides if they are going to extradite you (unlikely). However, if you have no reason to have contact with the police then its unlikely that they would be chasing you down.
