    Who Controls a Child's Use of a Computer
    My question involves a child custody case from the State of: NY
    My ex spouse is trying to forbid me to use my son’s computer. He claims my son does not have access to computer, that i have taken control of it. He threatens w legal actions and i have received a letter from his attorney. My son has full access to computer, i do use it from time to time. Does he have a right to dictate what goes on in our house?

    Unless it is in a court order the answer is no.

    I do not disagree with the other response that you received. However, the fact that you are receiving a letter from his attorney tends to indicate that its not as simple as "I do use it from time to time".

    If the computer is actually owned by the other parent then you have no business using it. In fact, ithe other parent does in fact have the right to deny your use of the computer.

    It was a christmas present to my son from grandparents and father in 2013

    Nothing in court order. Computer was a christmas present to my son from father and grandparents in 2013

    He alleges i have taken full control of computer and refuses to let son use it. Computer sits in our kitchen where my son has free access to it at anytime.

    If its your son's computer, why does it sit in your kitchen instead of in the child's bedroom?

    It's been preached for many years that computers should be kept in family areas so parents can monitor their child's online activities.

    My son has no devices in his room. If he did he would sit up all night using them. Where i chose to store things in the house shouldn’t matter. If I don’t let my son play certain viseo games shouldn’t matter either. Point is the computer sits in the kitchen.

    Correct -- and, consistent with bjoren's practices, it's also generally accepted that electronics in kids' rooms can affect their sleep patterns.

    I think the other parent and lawyer are blowing smoke. It was a gift to your son and it is in your home. I'm assuming you have primary custody and you certainly control what happens in your home. I doubt a judge would tell you not to use the computer if it did go to court if for no other reason than so you could check on what you child is doing in this times you aren't directly watching him use it.

    That would be like him receiving a TV and the other parent saying you can't watch it.
