What Are the Chances My Ex Gets 50/50 Custody
My question involves a child custody case from the State of: New York.
Hi, my son is 5 years old and I am taking his father to court for taking him to preschool 37 times late and 8 times late home in the summer. Currently he has every other weekend Friday-Monday, every other Tuesday night until Wednesday morning and every other Thursday until Friday night. I am asking he no longer has overnight visits during the school week, but only a couple hours after school. It is in the court order he is to be on time for school which we agreed to the first month of pre-k. He has filed a modification of his own requesting every other week. This is on the basis that he says we do not agree on holidays and I keep my son from him for weeks at a time, I can prove these are not true. What are the chances he will get what he asks for? Also, is there anyway I can put something in the order to prevent him from being my son home late, he has blatantly told me he does not care about the court order?

Tread carefully here; pre-K is not a requirement in NY and Dad may be able to convince the court that he doesn't have to take your mutual son to pre-K at all during his parenting time.
