Accused of Touching My Stepdaughter's Genitals
My question involves criminal law for the state of: Arizona
My 9 year old step daughter, I have been in her lofe.since she was 3, told her mom that she was not sure if she had a dream or if I touch her vagina in the middle of the night, I did not.
Her mom got worried and we went to a professional family counselor, the counselor because of the nature of the accusation had to call child protective services, this was reported on the 19th of October we got contacted today the 24th of October, when the counselor called the CPS hotline both her and the person evaluating the call said that I could stay in the home in order to not disturb the famliy, today cps asked my wife to bring our daughter to a center where she spoke to someone only to give a different statement to the one she had told my wife and the non cps counselor. For this reason the police department got involve and I now have a criminal and a CPS investigation against me.
Also cps told my wife she had to get a restraining order and she has 2 weeks to file for divorce, would also like to say that they removed me from the house and I can not have contact with the kids for a minimum of 2 weeks, we have a total of 6 kids, she had 3 from a previous relationship I had 2 and we have 1 as a marriage. I have raise her kids as my own since the biological dad was not involved.
My question is how far can CPS go and what is with in the law for them to "make" us do?

CPS can't tell your wife she has to get a divorce. If there are minor children in the home, they can insist at least initially that you not be present while the investigation is going on.
As LL said, you need an attorney post haste.

CPS has no need for your wife to get any restraining order to protect the children. They have all the authority they need to do that. And they have no dog in the fight as far as your relationship with your wife goes, so this statement does not make sense or ring true. I believe you have misunderstood something.
It would be normal for CPS to interview the child outside the presence of the person/people they are investigating for possible abuse.

CPS does that kind of thing all of the time. They even remove children from the home if their "orders" are not obeyed. That is why an attorney is so desperately needed.

That is true.
