How to Recover Overpaid Child Care Expenses
My question involves a child support case from the State of: Pennsylvania
Filed petition for Modification of child support CS. Conference held recently
Awaiting results of conference. CS is 903.00. Of that amount 261.00 is for child expense that was awarded in prior modification 2010
. Reason for petition was significant change in the support of minor child. Child no longer in daycare summer care.
Minor child is 15 years old. Last known day care/ summer care 2 years ago. Reason for late filing was that I did not recognize (read) the CS order. And she did not notify Domestic Relations or me of change.
The overpayment of child expense was not addressed at modification conference. Which I understand. Petition for Overpayment filed week prior to conference. My concern is will the petition for overpayment cover or address those two years of overpayment of child expenses ?? In Pa rules states DRS can reduce new CS order by 20% . Currently have 3 years left until my child turn 18.

If reimbursement has been ordered, or if a credit has been ordered against future reimbursement, then the order should describe the terms / schedule for reimbursement or credit.
