    Returning to Kohl’s After Getting Banned
    My question involves criminal law for the state of: Indiana
    Two years ago I was arrested from Kohl’s in Texas because my two friends were shoplifting. However I wasn’t stealing anything. I actually paid for what I bought and have a receipt to prove it. They arrested me anyway because I was with my two friends. I wasn’t with them throughout the time we were shopping but I met up with them towards the end. After I paid. They banned me from the store in Texas. The case was dismissed and I now live in Indiana. Will I be able to shop here and go into the Kohl’s in Indiana or would it be a problem? I have a gift card that I would really like to use.

    So you are saying that the criminal case against you was dismissed? You would probably be safe going into a Kohls store in Indiana as long as you were not trying to use Kohls cash or anything like that that would specifically identify you. However, you could also give the gift card to someone else to use.

    Your being banned from Kohls is not dependent on your criminal case and it being dropped is immaterial to you being banned. They can ban you if they like and they may consider you an accomplice.

    If you were banned chain wide, you are still banned. If you get stopped for whatever reason in any Kohl's, the fact that you are on their list means that criminal trespass charges can be brought and they will stick. You're free to contact Kohl's management and explain your case and ask for the ban to be drop.

    If you were only banned from the particular store in Texas, then you're free to shop in other stores in the chain.
