    What Happens if You Don't Consent to a Divorce Judgment
    My question involves a marriage in the state of: Washington

    My wife took my 11yr old daughter, now 12yrs old, out of state a year ago. I allowed it because of my daughters well being. My wife has filed for divorce in Wahkiakum County, WA, were she can do so by mail if we both consent. I signed papers that state I will pay $1,000.00 a month in child support. On the 18th of Sep the judge kicked back the papers, something to do with the child support is what the court clerk told me. The papers are supposed to go to the paralegal for amending then to my spouse and I for resigning.

    If I don't resign this next round, can I file in another for divorce in another court?

    I cannot answer that question without knowing what state your wife and child live in and what state you live in.

    You’ve already consented to the action in the current county?

    if so, then no, you don’t get to refile while there is an active suit that you’ve already agreed to be heard in that court.

    Just because the current order is not agreed upon it doesn’t mean the case is dismissed. It just means the fighting shall begin.

    If you're to the point of consenting to a judgment, then you've already consented to the court's jurisdiction over you. If you don't sign the judgment, your wife will presumably ask the court to put the case onto the contested docket and schedule it for trial.
