Is It Possible That I Can Get Emancipated
My question involves a emancipation case from the State of: Indiana
I'm 16.
Is it possible for me to get emancipated?
Reasons for emancipation:
Verbal abuse for years on in (b****)
Alcoholic father
Physically fights with mom
Mentally unhealthy and physically unhealthy mother
Absent father (always at work, never around, and when he is around he is rude, cruel, and busy)
Father doesn’t make as much money as he once did
Support and School:
3.0 in school
Part-time job
No criminal record
I’m able to pay for phone bill ($30)
Make enough money to have an apartment
Make enough money to support myself (buy clothes, shoes and food)
I have many volunteer hours
I buy my own personal needs (pads, hair products, phone’s, body wash etc..)
I'm wanting to get emancipated because I'm able to support myself. The reasons are there to make the judge not only want to get me emancipated because I'm able to support myself but also because it's in my best interest.
Thanks for any feedback.

Re: Is It Possible That I Can Get Emancipated
There are so many threads on here about emancipation.
Emancipation is not a means to remove children from abusive situations. If you believe you are being abused, you need to tell an adult or call CPS.
In addition to this, you need to already be supporting yourself.
-
Re: Is It Possible That I Can Get Emancipated
No. Based on what you have posted, emancipation is not an option for you.

Not gonna happen.
Turn yourself over to child protective services for help.
If you don't want to do that, just suck it up until you are 18.

In addition to the bolded... What about transportation? Insurance (car if needed, as well as medical)? Entertainment? Emergency? Furnishings? Utilities?
-
Re: Is It Possible That I Can Get Emancipated
And you're forgetting the huge issue of transportation. Could you continue to work and do everything you do if you did not have a car? I very strongly suspect that you are not the title holder of your car, nor do you pay for your own car insurance. How about cell phones and such? At sixteen you cannot sign contracts or leases for things like your own apartment. And since your situation and your ability to support yourself are so tenuous (a part time job does not make you somebody young and very very rich) a judge would not even CONSIDER letting you become emancipated in the circumstances you describe.
-
Re: Is It Possible That I Can Get Emancipated
transportation- bus, my jobs has me on their insurance.
-
Re: Is It Possible That I Can Get Emancipated
$600 per month is far too little for self-support. That's well below the poverty line.
-
Re: Is It Possible That I Can Get Emancipated
I don't have a car but if I were to get one it would be a cash car, and I wouldn't have to pay a car note. I never said I was young and RICH but I do have money. I have thousands saved up. So I'm sure I could take care of myself especially because the money I spend, I make right back.
I have money saved up. $600 is just my income as of right now.
-
Re: Is It Possible That I Can Get Emancipated
You are free to file a case and try to convince a judge that you can self-support through the age of 18 on your savings and your far-below-poverty level part-time income. Just don't be surprised if the court disagrees.

No you can't. Read the dozens of threads on this page about emancipation.
Nothing you stated meets any criteria to get emancipated. If you or someone else is being abused talk to a trusted adult or call the police.
Odd that you want to just leave your defenseless mother...

Re: Is It Possible That I Can Get Emancipated
You will not be emancipated.
The end. Even if.
-
Re: Is It Possible That I Can Get Emancipated
You have a roof over your head, lights, water, gas and food. That is all the law requires you have. By the way, I'm sure your parents have set up your college fund so they control it after you turn 18. By the way as long as you are a minor none of the money you have is legally yours. Your parents do not have to allow you access to it or give it to you
-
Re: Is It Possible That I Can Get Emancipated
no that money is strictly for me but i cant get it until i am 18 (when i would be going to college) my grandmother passed and gave that to me
-
Re: Is It Possible That I Can Get Emancipated
If it is for college there may be stipulations to you getting it at 18. For example, you might have to be in college, and spend it on paying for college

Re: Is It Possible That I Can Get Emancipated
Sweetheart, seven thousand plus an income of $600 a month isn't enough to support you for even one year, let alone two. You'd be pushing your luck on self-support even if you used all the money in your college fund for living expenses instead of college.
-
Re: Is It Possible That I Can Get Emancipated
$11k isn't going to pay for much of college, I hate to tell you. And Bs will not get you much in terms of scholarships.
-
Re: Is It Possible That I Can Get Emancipated
Let's see:
income=$7200/yr.
Median rent in Indiana-$9120/yr excluding deposit move-in fees, etc.
Phone is $600/yr
Bodywash, well, I don't know and it doesn't matter. With the above numbers this is going nowhere. Rent already ate up your income and we haven't even gotten to food, utilities, and the myriad other expenses that we adults all pay without even thinking about them, like my coffee (at home)
Your 3.0 GPA won't get you any awards and yours is hardly the first posting wit these questions and justifications. Perhaps if you actually read them and the sticky threads you'd find that you're going nowhere fast.
By the way, no one cares that you can pay for your own phone and the attached bill. Why do teens keep bringing that up? Oh yeah, it's absolutely central to their lives.

I'm still saving up for college. I can also get student loans. My apartment is $97 a month, I'm sure 600 is more than enough for that. it's an apartment I don't have any bills but my rent.
-
Re: Is It Possible That I Can Get Emancipated
$97 a month for an apartment? That seems....sketchy. What about your utilities? If they are included in your "rent", that seems even sketchier. What about groceries?

You will have other bills. Groceries, electric, utilities and other necessaries that you don't even realize. As for student loans you will require your parents cooperation as you will need their financial information to complete the FAFSA and you cannot get away from that until you're 24.
Also, you'll have to demonstrate an ability to pay market rent. The dollar value I gave you was the published current median rent in Indiana...all of Indiana.
Your lack of realization of these factors is why judges don't like to emancipate. They don't like the idea of cutting foolish children off from their support systems permanently. Emancipation doesn't make you an adult, it only provides some relief so that you can sign contracts. It doesn't mean that others have to enter into contracts with you.

I don't have any, that's why I just have my rent. My sister works there and she get's a free room for living if she wants. she could possibly give it to me and then I wouldn't have to pay rent. Groceries aren't an issue. Groceries are cheap and affordable.
-
Re: Is It Possible That I Can Get Emancipated
So you are not paying market rate rent? Well, that's a deal killer.
Is this a room in her apartment or an apartment that only you are in? Does her employer know she is allowing someone to live there that they don't have a lease or any information for and who is a minor?
What happens if you have to move and can not afford market rate rent?

In order to even begin to be qualified as one of the 1% of minors (if the percentage is that high) you would have to able to pay market rent, not "I'm staying for free at my sisters" of "my boyfriends parents said I can live there" rent.
You likely have to already be living independently as well.

Wrong. You're a minor. You don't have control of it. I guarantee it's in a trust that your grandma set up that has one of your parents on it as a guardian. Also the money you have saved they can take. Facts.

you have ABSOLUTELY NO IDEA if i'll get emancipated or not. so you telling me that I won't get emancipated is bs. are you a lawyer? are you a judge? NO, I didn't think so because then you would have something else better to do than go back and forth with a teenager on the internet.
before you tell someone that this or that isn't going to happen, make sure your licensed in the state because I highly doubt that you're a licensed judge or lawyer in the state of Indiana.
what you're telling me ISN'T FACTS it's your OPINION.
I never once said my mother is "defenseless"
It's not a trust fund either sweetheart, it's called a will and the courts have already said the money is STRICTLY FOR ME NOT MY PARENTS.
I never said I was being abused, I said I've gotten in physically fights with her before. It doesn't mean I get into them everyday.

I can give you a straight up act: you. Will. not. be. Emancipated. There!
You are an ignorant and snotty wee little teenager, so much like my daughter. You don't like what's being told to you so you fight it. Less than 1% of petitioners get emancipated. that's another fact. It usually involves them already living on their own, demonstrating that they can do so successfully, can provide entirely for themselves and they are petitioning so they can get enter into contracts. Emancipation isn't so children like you can stomp off when they are unhappy.

Re: Is It Possible That I Can Get Emancipated
I can promise you that you are not going to be emancipated on the basis that maybe your sister will give up her free room and let you have it. Or even on the basis that she will share it with you. You are going to need to prove that, should she, or you, lose access to that room, you will be able to pay the full market rate for a replacement. You can't do that, you can't be emancipated.
