Caught Shoplifting, But No Court Date a Year Later
My question involves criminal law for the state of: Washington State
Over a year ago I was caught shoplifting $147 worth of merchandise, something I regret immensely. I was told at the time that I would get a court date and a fee from JC Penny for the theft, they said these were completely separate things. They said I would get these in 6-8 weeks. Three months later I did get a $350 fee from a collector for the incident and payed it. Now it has been about 13 months from the incident and i have not gotten a summons. I am 19 years old and would not like this on my record. How much time must past after the incident for me to be out of the legal woods? or it there no set time? I doubt I am clear, but I want to know what to expect or what I should do at this point.
Re: Caught Shoplifting Jc Pennys, No Court Date a Year Later
Theft of less than $750 is a gross misdemeanor which has a 2 year statute of limitations for prosecution.
Re: Caught Shoplifting Jc Pennys, No Court Date a Year Later
Thank you, I have read that before, knowing the system though I get so worried!
Re: Caught Shoplifting, But No Court Date a Year Later
Check with the court where you would be prosecuted to see if there is a case open in your name, for which you were for some reason not served with a summons.
If there is no such case, even if it is theoretically possible for a charge to be filed, more than a year after the incident it's highly unlikely that it will happen.
Re: Caught Shoplifting, But No Court Date a Year Later
I periodically search for my name in the court data base and I have never had a case in my name. I am wondering why they would not go to court since JC Penny does have a prosecution policy. For this reason I am very cautiously optimistic that they did not pursue a case.
