Can You Get an Annulment Over an Error on Your Marriage Certificate
My question involves a marriage in the state of: nevada. So my husband and I got married in NV while he was in the process of changing his name in CA. When we married the license showed his old last name. After he got his last name changed the state of Nevada will not change our license. Now I can't change my last name to his new one since the license shows his old last name. Can we file for annulment?
Re: Can You Get an Annulment Over an Error on Your Marriage Certificate
No, a clerical error of that nature is not grounds for annulment. Odds are it's not even an error -- that is, odds are the marriage certificate simply reflects the surname you and your husband placed on your application for the marriage license. There's no fraud. If you no longer want to be married, you will need to file for divorce.
If you want to stay married, but want to change your surname, simply file for a name change. It's a bit more complex when not done in association with marriage, and carries some expense, but less so than filing a divorce action -- and it makes no sense to end your marriage unless you actually intend to end your marriage. (Ending the marriage and remarrying would be even more expensive and time consuming.)
