Extortion After Accidentally Sending a Nude Photo
My question involves criminal law for the state of: Dealware
So i accidentally sent someone on an online dating site a nude photo and she is now threatening to sue me, it was an accident and was only one. she says if I dont pay her 1000$ by the end of the day that she will press charges and post my picture to my facebook and other social media, she lives in China. Do i have anything to worry about or is this someone just getting lucky and trying to scam me? PLEASE HELP IM GETTING PANIC ATTACKS

So you were planning to date someone who lives in China? Really?
Just how was sending a nude photo an "accident" anyway? You just have them lying around on your hard drive?
You can always secure your Facebook account so that non-friends can't look at it or post things.

it was on skype, i know its hard to believe but i was sending a regular picture and just clicked the wrong one. :( im not super worried about the facebook thing, ive deleted all my accounts months ago anyway. I just need to know if im looking at any legal trouble as she tried to extort me for this money. my understanding is that what she is doing is far beyond what ive done in a criminal sense, blackmail and extortion etc.

If she's in China, she's not going to get you prosecuted for anything in Delaware. If you send her money, there is nothing to stop her from asking for more.

Thank you guys for your quick responses, this is the last time i dabble in online dating or for that matter skype. I told her to get lost and that she was doing something worse than my accident. people will try and steal money at any opportunity these days

Accident my a^$. I have exactly 0 nude photos of me drifting around on my hard drive. 0. If I did I'd have those segregated from the rest of my photos which would make it all but impossible to send "accidentally". If you have all of your photos, including nudes of anyone, jumbled together in your hard drive you are an idiot. All that said...
She's in China so you really don't have any legal recourse at all. Send her the money, don't send her the money there is no guarantee as to what her actions are, especially since she has the image (lovely thing about digital images, no need for negatives). She can post the image almost with impunity wherever she want online and, if she has your real name, identify you as the subject. While China may sanction her, if it chooses to, it's highly unlikely. I have a better chance of finding a pony made of diamonds in my garage playing with a unicorn than you have of getting China to do anything.

What the heck? So you keep a stash of nude photos on hand just in case? Weird.
The last sentence - have you done a lot of blackmailing and extortion in your life? (You don't have to answer that it was just a peculiar statement).
It's a scam. Don't send nude photos anymore or talk to anonymous people online.

I think he was referring to the "crime" of sending this "girl" a nude photo of himself.
