    Emancipating at Sixteen in Florida
    From what I have read there doesn't seem to be a way out for a 16 year old in Fl. You wrote that a parent or legal guardian has to apply for my emacipation. I live in Fl with my mother who is the custodial parent but I am so unhappy I just can't take living there anymore. I have my dad who lives in another state and my grandparents who live in Florida but other cities all willing to help. Can my father file these papers even if he isn't the custodial parent and is so would they have to be filed in the Florida courts or can he file in his State? Please tell me there is something that can be done. If not can I leave to live with dad or grandparents when I am 17? I have 2 years of highschool left and I want to finish but I feel if I have to stay at home with my mom and her boyfriend and his kids I won't be able to take it much longer.

    Probably not, as he isn't a state resident, and even if the court were to entertain his petition they would have to address the fact that he's not the custodial parent.

    If your parents give you permission to live there.
