Yes shooting at your kayak is a criminal act but you said you've given up contacting the authorities. Also, you said "somebody". Is that somebody the neighbor you are having trouble with? If not, I'm missing the relevance.
You also have stated the neighbor said he will give the home to the people that live under him. Is the home a multi family dwelling? Are your problems with the owner or a tenant in the building?
you refer to the neighbor like it's a single person but it sounds like there are multiple parties involved. The issues with one person does not extend to others.
Did you witness them shooting at your kayak? Did you report this to the police? Did they admit to committing the act?
As I mentioned, most verbal threats are not criminal in CA. If these threats violated the CHO then you need to report it to the Sheriff's Department, and if they refuse to act (i.e. to take a report) speak to a supervisor. If you are expecting them to kick in doors and take people to jail for violating a CHO you will be disappointed. While it is possible to make an arrest for this violation in some circumstances, typically, the matter is forwarded to the DA for follow-up and charges.
There are 3 in the home 1 older guy upstairs (the owner) and 2 people in their 50's downstairs (they have no lease). I have a small claims judgement on the owner and a restraining order on the 2 downstairs. Also the 2 downstairs have many guests and traffic to the house. The video of the kid shooting the kayak is walking the dog of the owner of the house. The 3 kids come out of the neighbors house and shoot my kayak. Yes I witnessed the guy shooting my kayak. But I don't know his name or where he lives. And yes I did report the shots at the kayak. But I had to do it online because I work 15 hour days and I still have 10 more days to go before I might have a day off.
So, when you called the Sheriff's Department and showed them the damage to your kayak and the video of the person shooting it, what did they do?
It would likely only be a misdemeanor (vandalism) at this point, perhaps with misdemeanor violations of muni or county codes for discharging a firearm in city/county limits so they could not start serving search warrants and kicking in doors looking for the guy.
Unfortunately, CA law does not grant law enforcement much authority to act aggressively or immediately in such matters. Thank the state legislature.
