    Taking Money Out of a Joint Bank Account Prior to Divorce
    My question involves a marriage in the state of: Washington.
    My question is right now we are having problems but all of my payroll checks goes into my wife's (for bill purposes) credit union account she gives me the debit card to that account to use, and gave me permission to use.
    but now that we're having problems I found out she has a separate bank account somewhere and will not give me the password to the credit union account just so I can look at the account history is all I want to do. That credit union account is in her name and her name only.
    I'm considering going to the ATM and tranfeering all or most of the money and and putting it into my personal bank account that she knows about.
    I can prove where the money came from I can prove that she gave me permission to access and use the account card and so forth.
    but I need to find out is there any possible criminal legal problems to that?

    If you're planning on filing divorce, consult a divorce lawyer and discuss strategy with your lawyer. If you're not, you may find that draining the account causes issues such as bounced checks or rejected automatic payments, plus you may find that it inspires your spouse to file for divorce.

    Removing the money from the account that pays the bills is a problem. By all means stop the direct deposit of your paycheck into that account if you feel it appropriate to do so, but risking bouncing bill payments would be foolish. Of course, if you do stop the direct deposit you will still need to cover your share of the bills.

    I suggest that you open another bank account (if she has access to your present personal account) and have your payroll checks deposited into that account. Get your own debit card for that account and use it for personal bills. Each month, you transfer money into the joint account to cover whatever you agree is your portion of the living expenses. Keep it to the household expenses. You pay your personal expenses and she pays hers.

    A joint account can be drawn down by either of the signatories without the permission of the other. If you feel that you have funds in the joint account that you want to move, then do it but stop the direct deposit moving forward. One morning you may find that your wife moved the funds and they will be out of your control.
