Can You Pick Up Prescriptions for Somebody Who is in Jail
My question involves criminal law for the state of: My boyfriend is in jail and is asking me to pick up his prescriptions for him so he will have them when he returns home. My question is if that is illegal because of him being incarserated? I've picked up his prescriptions many times from the same pharmacy so I know that is not illegal with his permission but I don't know if it's illegal to pick them up while he is in jail even though I have his permission?

The smart thing to do would be wait until he gets out of jail and have him pick them up.

You posted this as being about drug possession. Are we talking about controlled substances?

Does he need them now or can they wait until he gets out? If it can wait, then just wait until he gets out. You know when he gets out right? He can get them when he gets out. But if he needs them now he should be able to get them while he's in jail from the jail.

If we are talking about a controlled substance that is habit forming, and he will be incarcerated for a very sort time (say a week or less) then you will have no problem picking up the prescription.
If he will be incarcerated for a longer time, then you may just find the DEA knocking on your door.
How will they find out? The county/state that will give the prescription will bill his medical insurance and or medicaid / medicare. They will see in the system that the pharmacy is billing for the same medication that the county/state is.

Apparently we're not going to learn the other relevant facts, but.... if the inmate needs the medication in jail, it would be better to have the prescription transferred per jail policy because you can generally count on a jail refusing to accept medication that is not dispensed internally by its own medical staff. If he doesn't need the medication while in jail, the question becomes, why doesn't he simply wait until he's out of jail and fill the prescription himself?
