    Is it a Criminal Offense to Stop Payment on Your Rent Check
    My question involves criminal law for the state of: Georgia.

    My tenants wrote me a check for rent back in July of 2017. I deposited it, as usual. It was returned with a "stop payment" order on it, and I didn't receive my money.

    They have yet to make good on this check. And now they haven't paid August's rent, either.

    I want to pursue criminal charges for the bad check. Can I do that? Or can I only pursue civil action? Or can I do both?

    Frankly, if you have to ask about this and the other thing, you need a lawyer to handle this tenant for you.

    Correct. Same tenant. And I'm hiring an attorney. Unfortunately she's too busy to meet until next Monday, so I have to wait a week to talk to her.

    But anyway, what are my options about pursuing criminal charges against them? Anyone know?

    Go to the local police department and ask them their procedure for bad check complaints. Many police departments will have a procedure whereby you must give formal notice to the issuer, and an opportunity to pay, before they will pick up a bad check case.
