Can You Get a Student Visa After Overstaying as a Child
so this is the case. my parents overstayed in America in 2003 by applying for asylum.They overstayed like 2-3 months. at that time i was a child 7-8 years old i had nothing to do with this as you can see i was a minor.Then they voluntarily left America by taking back their case and came back to home country. then in 2005 they applied for me for another tourist visa which i got for 5 years from 2005 till 2010. which i did not use and got expired without use. Then in 2013 i applied again with my father for tourist visa. my father told the visa officer everything that they claimed asylum and overstayed so the visa officer did not give us visa. then in 2016 i again applied for visit visa. The visa officer at that time asked me, what happened last time when u went to America? so i didn't want to answer him what my parents had done and also i had nothing to do with it because i was a child at that time so i said, "i don't know". so he did not give me visa. So now my main question is that can i get a US study visa for US because i want to study in US, because in 2003 i was a child and had nothing to do with the asylum and overstay. so how can i get the visa , how should i explain my case to the visa officer to get a visa? because it was not my fault and i had nothing to do with this. if someone could explain this it would be really appreciated. thanks

You should have provided an honest answer. You may be able to get a visa, as your childhood unlawful presence would not be counted against you, but your claimed memory lapse can create problems of another sort -- making false statements to gain entry into the U.S. can result in permanent exclusion. At least it wasn't a false denial, so it's something you can probably overcome in the future.

Hi. thank you for answering me. i know i should have answered correctly in 2016 but i just said i don't know i was a minor that's it i did not explain everything. So now what should i do? when i apply how should i put up my case? what should i say to them? i have no intention in staying in America, i just want to go for study i will leave America. so tell me please what should i do when they ask me in the future should i tell them about my parents asylum and overstay? and also because after that i also got another visit visa in 2005 for 5 years which i did not use. so what should i do now please guide me. thanks

When you deal with USCIS, tell the truth. Talk to your parents about your childhood travel dates. If you said "I don't remember" to a question, you can give an honest answer. If they ask how you remembered, you can say you spoke with your parents. As you will be trying for a non-immigrant visa, you should also be prepared to show strong ties to your nation of origin, and that you will be able to legally support yourself during your studies in the U.S.

Hi. thank you very much for answering me. and i also wanted to ask that if they ask me about what happen so should i say everything about overstay and the asylum or not? i fear if i say about the asylum they will think that i will also claim asylum and not give me visa. so what should i do about this because at that time i was only a child i had nothing to do with this? how should i prepare myself for this? and also what should i also do more to show my strong ties to my country of origin?what are the main and most important factors for this? again thanks for answering me. :)

Having a job, owning a house are considered ties to your home country. Having a spouse and children still in your home country can make a difference, too.
