How to End a Joint Lease With Your Ex- Still in Residence
Ok so I cannot figure out how to post a new thread so sorry but here is my situation. My ex and I broke up about 10 months ago but due to finances we decided to stay as roommates and sign a new lease. 6 months into it I cannot take it any longer and one of us needs to go. She refused to move out for another 4 months and says she has talked to the management and they say I am considered head of house just because my name is listed first on the lease. We both signed one contract and I looked at my lease and saw no signs of anything stating a head of house. Due to my work schedule I can never talk to the leasing office and they never awnser the phone. So I have to go by what my ex says. First off does anyone know if there is a Head of house if there is no actual clause stating such and both tenants signed the same lease and at the same time. Also if I am HOH what rights does that give me to work with the leasing office to force an eviction or vacate notice on her to get her out sooner? The ex is saying all she needs to do is sign a peice of paper and she will be free of any responsibility after her move out but if i wanted to vacate premises it would be considered breaking the lease since I am the HOH. Don't I have to sign her out of the lease? I live in Ohio by the way I know laws are different everywhere.

Your ex is full of it. There is no HOH you are joint tenants.

Never take legal advice from your enemy. You are both equally liable to the the lease.

Even without that HOH business, you have no rights to force anything on her nor will the leasing office lift a finger to help you.

The only person who can release either of you from anything before the lease expires is the landlord.
And I can almost guarantee he won't.
You are free to pack up and move out whenever you want. Just understand that you are still both obligated to the landlord. If you don't pay your share, the landlord will expect it from the remaining tenant. If the remaining tenant doesn't pay, an eviction will be filed with both your names on it and the judgment will have both your names on it. Then the landlord will go after both of you but collect from whoever is easier to collect from.
