Do You Have to Pay Child Support After a Minor Child Gets Married
My question involves a child custody case from the State of: Texas

If the custodial parent signs the marriage papers for a 17 year old, do they still have control over their affairs? What if the married child is not fully independent and they are still relying on the custodial parent for financial support? Do you have to pay child support if the 17 year old is legally married? Thanks.

Re: Does Marriage of a Minor Emancipate Them Do You Have to Pay Child Support
If the child is married it seems that they are emancipated. So whoever is paying child support needs to go and file for it to be stopped. But the NCP owes whatever is in arrears.

How is the child married and still depending on their custodial parent? The custodial parent needs to squash that but it's up to them. If they want to help their married child that's on them. But the custodial parent has no more control over them once they allow their 17 year old to get married. I've seen most states marriage is emancipation if it's before the age of majority.

You pay child support until a court says you don't.

If your ex allowed your 17 year old to get married, immediately petition the court to stop the child support due to the marriage.

I read it more like, if I sign the paperwork for my 17 year old to get married, can I stop paying child support? Or possibly, will my child support stop or can I still get paid?

    Perhaps some clarification is necessary.

How can you find out if the kid gets married?

If you want to find out if they got married, check for a copy of the Marriage License in the county they got married in. You may be able to do this online. If you can't do it online, you will need to go to the court house. If the county has online access to their marriage licenses, there should not be a charge. It may take awhile for the marriage license to be listed online. But the County Clerk's Office should have a record of it if it has been week or two.

The issuing of a marriage license itself does not prove marriage. It proves a marriage license was issued. Only after the officiant completes and submits the certificate to the state is it valid. You would seek that record from the state of Texas office of vital statistics.

I don't believe the recorded certificate would be found at the county level especially if this has been a recent event, even if the county also maintains a copy of
the states records. Such records are maintained by the state.

"Certified copies of marriage licenses or divorce decrees are only available from the county clerk (marriage) or district clerk (divorce) in the county or district in which it was obtained." So the OP could find out if a marriage has occurred by going to the County Clerk's Office in the County the couple was married in.
