    What Will Happen to a Minor Facing a Drug Paraphernalia Charge
    My question involves criminal law for the state of: Georgia

    I was with some friends in a car, we got pulled over and to the cops the car "reeked like weed". They then presumed to searched the car and found some weed which wasn't mine. I did have two glass pieces in my bag which they found. I'm 16 turning 17 in a couple weeks, what exactly am I going to be charged with, and will I have probation/community service? I have a completly clean record, and have a high gpa in school if it matters.

    You can be charged with possession of drug paraphernalia and, if it tests positive for drugs, with possession of the drugs that you used in your drug paraphernalia. As you committed your crime at the age of 16, odds are you'll have to go to juvenile court. You will have to wait and see what specific charges are filed; your disposition will depend upon factors including your age, your home, school, community and prior police record, and whether the court believes that you have a substance abuse problem.

    I believe I was only charged with drug paraphernalia. We hadn't smoked but there was definitely residue in it. But can they charge me for possession of drugs if there weren't any drugs on me? I've never been in trouble with my school, family, or community in any way. And how much will the actual fine be?

    Sorry, the crystal ball is out being recalibrated.

    And no, a high GPA only means that you're smart enough to know better. It isn't going to cut you any slack.

    At this point you don't even know what charges you may be facing, let alone what the disposition will be.

    By the way, if you get convicted of drug possession, it will work against your financial aid in college. So much for the high GPA.

    The "it's not mine" is not a defense to a possession charge, by the way. If it was in the car with you, you possessed it. You're going to be in trouble over the two bags.

    As for "dirty" paraphernalia, in Georgia, it's likely to support the paraphernalia charge (police usually won't charge and the courts won't convict an unused item that might be paraphernalia. Even though nobody uses glass pipes for other than illegal drugs, one still argues you may not intend to use it for such. You got to have a lot of drugs still present in the device to test enough to support a possession charge. Georgia can not convict on just "residue" in the praphernalia.

    So your saying even if the driver took responsibility for the marijuana I can still get charged with it?
