Charged With Strong Arm Robbery After a Shoplifting Incident
My question involves criminal law for the state of: ca
Should I hire a lawyer her is the run down about a year ago I was leaving home depot shoplifting. Stupid bad choice. Either way a man followed me out and asked for my reciept which was in my hand . I turned back and walked towards him and handed him my reciept . At that point he did not even say who he was. Ok I badge no name tag. I told him no I wasn't going with him when he asked me to come back in. At that point he grabbed my arm and we got into a alter cation then during our struggle another man ran out and handcuffed me. While on the ground. I have a history of dealing with dv and didn't mean to flash but he grabbed me. As we walked back to the office while handcuffed he had whispered in my ear small threats as he held my arm tighter. The guy that had approached me and grabbed me in the beginning at that time disappeared when the police showed up. Never gave a statement to him. I was cited and released. Bc only loss perventio n talked to the officer. And he told me he knew how to rite a report and he would make sure i got into trouble. A year later I get issued a strong arm robbery warrent. Now i have to fight this charge . With a prior prison charge of grand theft. Should I fight this???
Re: Should I Get a Lawyer
Whether you should fight it or not is a decision for you and your attorney. Robbery is a violent felony almost certain to result in prison time - or, given the recent trend at the decriminalization of crime in CA, county time and PRCS (effectively, parole monitored by the county's Probation office).
But,when you actively fight in an effort to get away with ill gotten goods, it's robbery in CA. So, consult an attorney and hope for a good deal to be offered by the DA.
