    Emancipation of Minors in Virginia
    I'm 16 years old, 3 months from 17, and I'm trying to get emancipated. I have plenty of reasons for showing that my parent is unfit to be my guardian. For one, I have not been living with him for about 2 months. We were staying in a motel for a couple of months because we were evicted from our last house. All my life we have moved from one house to my grandmothers house and we would do that every year because we could never keep up with rent.the main reason for that is he spends all of his money on cigarettes, alcohol, and Red Bull. I live in virginia and my father and my mother decided to pack bags and leave without me to a whole other state.They've been gone for about a month and I have been staying with my great grandmother. I buy all my own food, I pay my own phone bill, I go to work almost every day, and I'm about to get my second job.my father has also put a cable bill in my name even though I'm not 18. I want to get emancipated and stay with a cousin for a Month or two until I can comfortably get my own apartment. The main reason for me wanting to be emancipated is because first, I do t want to leave behind all of my family, friends, and school here. The second reason, just like every year, I'm afraid we would be evicted from a house in the other state and be stranded there. I definitely believe all these reasons would grant me the option of being emancipated. But the only problem is of course he would not be happy with this, my main question is all of that a good reason to get emancipated and do I need his concent. Also, is it even possible for me to get a apartment in virginia if I'm emancipated

    We don't emancipate people because they're parents/guardians are unfit, we find them alternate placement. You aren't getting emancipated with out parental consent in Virginia. It won't happen. In Virginia, you already have to be living apart from your parents BEFORE you apply for emancipation. Despite what you think you know about that word, emancipation isn't a procedure to escape parental enslavement. It's a recognition that an already indepedent minor needs relief from certain legal restrictions regarding contracts, etc...

    So could you give an example of someone that would be able to get emancipated? I'm being told all the information that I know from my brothers mom

    And I am living away from my parents though. I've been living away from them for about two months

    "My parents were killed in a car crash and I need to be legally emancipated so that I can get the light bill transferred into my name and pay the mortgage" is about the only example I've ever seen that would be considered a valid reason for emancipation. "I don't want to move" is not a valid reason in any state.

    Staying with your great-grandmother, who pays the rent and the utilities, does not constitute living independently, even if you do pay for your own food and phone bill.

    In order to be emancipated you must be able to cover ALL of your living expenses, at market rates, with you job(s) and be able to go to school and take care of all of the business of living as an adult...while not actually being one. Emancipation doesn't make you an adult. You'd be shocked what living expenses come out to be at the end of the month. You'd also have to convince a court that emancipation is in your best interests, which it really isn't in very nearly all cases.

    My older daughter is in the Navy and rents a room in the town where the base is as there is currently no base housing available. The costs between food, rent, her minor share of the utilities etc has been a real wake up call, to say nothing of all of the other tasks that go along with adulting. Don't rush it.

    If your father is putting bills in your name, I suspect very strongly that he is also using you as a family member on his public assistance case,not to mention his income tax credit, Medicaid, whatever he is getting. which case you are not going to get any kind of parental consent to become independent until he has to let go of you, which is about two years from now. The only alternative (unless you are a Miley Cyrus or Taylor Swift or Brittney Spears, a very independent earner before your majority) would be foster care. The state is not about to free you at 16 and a half to be on your own because your parents aren't so great. But frankly, if you are living away from them, and that's okay with them, they're not bothering you, you're able to come and go and have a job and maintain yourself as things are right now, what would be the advantage of being emancipated, even if it was possible (which as has already been pointed out to you, it will not be.)? All you'd do if you talk too much about it, is get your parents worried you're going to raise a stink which, as I said might put some of their benefits in jeopardy. Why call attention to it?

    I pay $200 rent, $40 electric, $50 cable, and I buy my own food. And please quit trying to make it sound like I'm some little boy who has no idea what he's talking about with "I don't wanna move". The man loses his job every year, and we move from one house to our grandmothers basement every year. Until now where she doesn't want us staying with her so we're all split up. Your acting as if it's just me not wanting to move because of friends. Like please🙄, there's to many fake people around here. So quit trying to be a dick.

    Again, we don't turn kids out to live on their own. Since you have a parent, the ONLY way the court will consider emancipation is if he agrees.
    If he wants to consent to you living with grandma, then you don't need emancipation for that.

    Despite your alleged budget, understand the court will want to see ALL expenses including medical insurance paid and you still attending school to consider emancipation.

    But regardless, the fact remains that nothing you have posted supports a NEED for emancipation - just a WANT. In the very rare cases that emancipation is granted, it is granted on need. You do not need emancipation to survive; you just want it.

    The amounts you list are chump change.

    Like so many children in your place you tell us, the seasoned adults, that you are our peer. I'm telling you that you are not. Your attitude and lack of comprehension is why teenagers aren't permitted to live entirely on their own and cannot enter into contracts. According to studies over the last 10-20 years it's been determined, in fact, that brains don't actually finish maturing until 25 or so (individual results may vary). Perhaps you and the slew of other dissatisfied children like you should count their lucky stars that the age of majority is not chosen by scientists but rather by politicians, a disturbing number of whom believe that the earth is 6000 years old.

    None of the Sr. Members around here are "fake". They are actual people.

    I think you need to read the plethora of threads on emancipation here in this forum and research it yourself. You have no clue what emancipation even consists of or what it's used for.

    If your parents are abusive or neglectful than you call the authorities or talk to someone you trust.
