What is the Penalty for First Time Possession of a Controlled Substance
My question involves criminal law for the state of: CA
In short, I was arrested for disorderly conduct and possession of a controlled substance without an RX. I don't remember the arrest, I woke up in a holding cell and was released that morning. I didn't know my charges until I got home. I don't remember putting the pills in my bag, someone handed them to me and that was the last thing I remember. I was in a blackout basically the entire night. I don't take pills, regardless they were found in my possession whether I wanted them or not. I have no idea what the pills were, I know they weren't Vicodin, they were small white oval pills. They almost looked like caffeine pills.
I've never been convicted of either of these crimes, both of which are misdemeanors listed on my ticket. I have 2 prior misdemeanor DUI's, one being over 10 years old and the second over 8 years. Other than that, I've never been in trouble.
I have a court date on July 7th and I don't have an attorney, I can't afford one at 1,500 for just a retainer fee. The PD wouldn't release the police report to me, only the DA received a copy.
I am terrified of what might happen. Does anyone have any input, it would be greatly appreciated. I don't want to walk into court and be completely blindsided. I just started a new job and I'm finally getting back on my feet again.

You can ask to have the public defender appointed to represent you when you are arraigned on the 7th. Drug possession for personal use is now a misdemeanor in CA. You will likely be given the option of doing drug diversion or drug court but it's always best to speak with an attorney and not just plead guilty at the arraignment.
