What to Do if You're Tricked Into Giving Home Co-Ownership to an Adult Child
I bought my home in 2008. I wanted to get an equity loan and since i dont have credit and my son does he was put on the deed as tenants in common. As soon as that was done my son told me the banks arent giving out equity lians anymore. I had my home sold but my son refuses to sign any paperwork for the sale of my home unless all the money from the sale goes into his personal account. He isnt my POA. Iam 60 years old and my health isnt good. I need to know all the proper paperwork and or forms i will need to have return his 50% back to me

Re: What Kind of Forms to File a Civil Lawsuit Against My Son Who is Out of State
You probably cannot force him to return the share of the home that you gave him. But you could do a partition lawsuit to force the sale of the home without his consent and try to argue to the court that his interest in the home is really next to nothing because he was only added to try to get you qualified for a loan. But you run the risk that the court will say he should get half the proceeds. You really ought to see a real estate attorney in your state to review your options.
