    Re: Help
    The WORST (from his perspective) that can happen is that he can go to prison for 10 to 40 years, or for life.

    The BEST (from his perspective) that can happen is that the prosecutor chooses not to file the case.

    And, no, he was not "just around at the wrong time." This is a serious offense and the type of offense that one has to try and commit. You do not accidentally commit an aggravated robbery!

    5-12-103. Aggravated robbery.
    (a) A person commits aggravated robbery if he or she commits robbery as defined in 5-12-102, and the person:
    (1) Is armed with a deadly weapon;
    (2) Represents by word or conduct that he or she is armed with a deadly weapon; or
    (3) Inflicts or attempts to inflict death or serious physical injury upon another person.
    (b) Aggravated robbery is a Class Y felony.

    For a first offense, he has certainly decided to go for the gold! A class Y felony in AR is the most serious type of offense there is! His attorney may be able to get a plea down to a lesser offense, but it is very likely that a prison stint is in his near future. It may be time to reconsider your choice of boyfriends.

    Actually, I had a friend that was on Ambien and wandered out unknowingly to a woman using an ATM and demanded cash, he ended up getting charged with attempted robbery but the victim requested they drop the charges and they did. He says he doesn't even remember the incident.

    EDITED: OOOPS! Thought you were the OP!

    The charged offense would seem to indicate that there is more to it than that. Note the elements in the charge which include the presence of a weapon or the threat that he has one, AND inflicted or attempted to inflict great bodily harm on the victim. A threat made by an impaired person is not going to meet this.

    Normally, I would be rather skeptical of your story. However, based on your prior posts and the amount of credibility you have demonstrated in the past, I have to accept this as not only absolute gospel, but also that it is a common occurrence that must be considered in any potential robbery scenario. <sarcasm off>
