Possession of Drugs, < 20 Grams
My question involves criminal law for the state of: Florida.
Hello, my name is Zachary and I was pulled over shortly after finishing smoking marijuana. The officer asked if I had anything in the car, which I immediately pointed out the 3 marijuana roaches sitting on my radio, behind the screen. I was given a citation for possession of less than 20 grams of marijuana.
I have a 6 month old daughter and plan on enlisting in the navy after her first birthday. I have been stressing and not getting much sleep, due to the fact I'm expecting the worse to happen. I do not want my chances of enlisting taken away and more importantly, I don't want to be taken away from my daughter, no matter how long it would be.
I used to smoke marijuana to self medicate myself, and haven't smoked since I was pulled over and won't ever again, being it's not worth being taken from my daughter.
If there is any advice you could give me or whatever you can do to help, it would be more than greatly appreciated.

That is a misdemeanor that could end with you having a permanent criminal record. It is unlikely that will receive any jail time if this is a first offense. You need an attorney.
Are you currently in contact with a recruiter for the Navy? If so, you should notify them of this because they will find it anyway. This will likely be a disqualifying event but you would need to discuss it with the recruiter. While a waiver is possible, it is unlikely at this time as the armed forces are still operating under a philosophy of lean budgets and staffing. If you are a highly desired candidate for whatever reason (intelligence, physical ability, aptitude for some difficult to fill field), that might save your bacon.

I have never been in any legal trouble and it was less than half a gram. *facepalm* I've taken my asvab and qualified, I just want to be in my daughters life the first year so she remembers that I'm her daddy. She's everything to me.
I've NEVER been in any legal trouble, and hope this doesn't stay on my record. I'm trying to find my own place, so don't really have the money for an attorney. I know getting a lawyer can be very expensive.

If you had plans to go into the military why on Earth are you using drugs? You realize that the military isn't issuing the waivers they did during the surge right? I agree you better tell your recruiter if you're in DEP (or whatever they call it now) or you've been in contact with one. They have to know. This most likely will affect your ability to enlist in the Navy.
You need to at least find a lawyer who does free consultation and find out your options. I very highly doubt in this environment of the military that you will get a waiver. I don't know how the Navy does it but you would definitely not get one in the Army right now.
Also leaving your daughter at a year isn't going to make much difference if you had joined now.

I spoke with the recruiter today who looked in the manual and said that it will not keep me from enlisting. All I've got to do is make sure to pay the fees and citation before enlisting.
I wanted to enlist after my daughter's first birthday so I could be there for most of her ''firsts''. I wanted to watch her grow.

Reason #1 I don't come to forums for help; illiterate ****s like yourself. Just wanted to see what people had to say and if I could get any good tips. If you knew how to read, I stated I was CITED for possession, not arrested.
Just because I'm pro weed, doesn't mean I have a "substance abuse problem". You can't even overdose on marijuana, therefore I don't think you could ever put those two into the same sentence without sounding stupid.
Marijuana is a plant that helps MANY people out in several different ways. If you do not understand this, then you need to read up on your facts. It's not even a "gateway drug" as people assume. I've been offered a few different things, but do not do DRUGS.
Now if I were addicted, which I assume is what your unintellectual self meant, I wouldn't quit smoking in order for me to enlist into the navy. I would have no reason for being drug tested and would still be smoking all of the marijuana I wanted to. I'm 20 years old and would like to better myself in a career, so I'm going to do so at a young age.
You can not so kindly go **** yourself, but after you look up how much marijuana has benefited several many people.
By the way, recruiter said I can enlist with my misdemeanor. Again, learn to read champ. :) I can't wait to bust my ass for my family and give them everything to prove to morons like you that marijuana doesn't make someone a bad person. Not that I will smoke again in the future, but will never be against it and it never changed me.

First off, when you start hurling insults, you should understand what the words mean. My post was quite literate. I'm not understanding what defect you find in them, but you appear to be lacking in communication skills.
The cite IS the arrest. Not all arrests result in you being hauled off to jail.
You can sit there and pout about marijuana being a plant, but many drugs are plant based. Just because it comes from a plant doesn't make it NOT a drug. And it remains that as far as your state, the federal government, and the MILITARY are concerned. It is an illegal drug. All your protestations do not change that. And the fact that your use of this drug is having adverse affects of your life (particularly since you insist you NEED it to cope), you do have the classic definition of a substance abuse problem. Normal people do not need durgs, plant or otherwise, to get through the day.
Also, mature and sober people can express themselves without resorting to profanity. You try that in court. Sorry, we can not paint the rosy picture you wan tto hear that you will escape consequences for your CRIMINAL action and despite what your recruiter told you that the military will be OK with you as a ongoing substance abuser if they even accept you now, but we're trying to be realisticly helpful here.
But since you act like a foul mouthed, immature sot, you can expect that most people here are disinclined to talk to you further. Good day.

I've only got one thing to say. It's something that one of my drill sergeants was fond of saying to the entire company and I'll bet that the navy equivalent said the same thing to my daughter and her division. You'll have to picture a man standing before you, you in the front leaning rest on a hot July day in Georgia: YOUR RECRUITER LIED TO YOU! YOU ARE NOT SPECIAL, NO MATTER WHAT YOU MOMMY TOLD YOU!
Does that help make things clear to you? The military is not your recruiter. The Navy, and all of the branches of the armed forces, don't take drug users. They usually won't take people with criminal records, especially freshly minted ones. They simply don't need to. I say usually because there are those rare cases where someone hasn't used in a long time (not you) that has special skills or highly desirable languages (also, likely, not you).

Nah, your ignorance is what triggered me. You're a nobody to me. A misinformed nobody, at that. I would never speak to a judge like that, are you dumb? Nowhere did I say I need marijuana to cope? I haven't smoked in 2-3 weeks and have 0 urged. I'm pretty sure I've already said this. I actually don't need anyone's help, now that I know I don't have to fight this misdemeanor. I can live a way more successful life than you with my "CRIMINAL" record. Suck a dick you piece of shit. :)
