    Summary Charge for Abandoning a Car
    My question involves a consumer law issue in the State of: Pennsylvania.

    My car was totaled and towed to the towing company's lot. I called the car dealership to pick my car up. Then I get a call from the towing company that it wasnt picked up a month later so I called the car dealership to pick the car up and they said they would. 2 months later I get a summary charge from the district justice for a fine of $1400. I sent a not guilty plea bc I did my part and now have a hearing but dont know if I have a chance. Do I just make a payment plan for it? Do I have any chance with fighting a summary charge? Will this go further then the district justice?

    If you were charged with 75 PaCS 3712, what I would do is get your abandoned vehicle removed from wherever you left it and then go to court. It's a $500 fine if convicted.

    OK, this is really bogus. You owe the towing company for the tow and storage, and if you're not going to recover the car from them, pay to have it disposed of.

    Now as for the 3312 violation. How did the car come to be towed in the first part (were you there when they had it hauled off as undrivable)? Are they alleging you "abandoned" the vehicle on the highway after the accident or because you didn't recover it from the tow yard?

    First offense abandonment is only $500 + the disposal costs.

    I was there andcthe police told meeting where it was towed to. I went to getvmy stuff out of my car a week later before the car dealership (where I bought my car) was to pick the car up. I left my phone number with the towing company in case they needed it. Then the towing company called to tell me no one came to pick it up. So thats when I called the dealership again to tell them to pick it up. They said that they. Might be able to use the parts from the car that wasnt wrecked. Then I get a summary charge in the mail. So basically it was abandoned at the towing yard. It was never abandoned in the highway. I had to be taken to the trauma center at the hospital by ambulance and a cop was the one that came to my hospital room to let me know where my car was towed to. So maybe they $1400 is the 500 for abandoning at the tow yard and for fees to store it there. So is there a way out of this charge and will it go to a higher court??

    I would figure out how to resolve the towing/disposal issues and the go to court and point out that you had not abandoned it at any time.

    Thank you. That is what I'm going to do tomorrow. Hopefully it will all work out.
